Up in Smoke!


Smokers of the World unite! The problem with Smoker’s is guilt and gutlessness. It is high time that Smokers of all stripes unite. A few comments on the proposed ban in two of California’s cities:

1. If a Landlord wishes to ban Smoking in his building, he/she has that right, but must inform their prospective tenants of this policy. If a Landlord wishes to ban Smoking after the fact, I think that’s unfair and those tenants should be grandfathered in.

2. The above applies to Homeowner’s Associations. I don’t think amending “covenants and restrictions” after the fact to enforce an anti-Smoker agenda after the fact is correct. For brand new subdivisions, sure a builder can write that in and market subdivisions as being pro-smoker, anti-smoker or whatever.

3. To all those that may be affected by this proposed law. Do NOT answer your door if a Landlord [I happen to be a professional Landlord], his/her Agent, and/or a Government official knocks on your door for Smoking. Ignore it. Most leases come with a clause that protects you, it’s called “Quiet Enjoyment.”

As a University student, I have consistently fought for and won my right to puff on many cigars EVERY single day. I pay enormous sums and have paid enormous sums for living quarters. The day that I enter a setting where I need to waive my right to Smoke, I will find an alternative free market solution if available. Plain and simple. But to change the deal midstream is unacceptable.
