Is Ron Paul a Hypocrite?


Ladies and Gentlemen,

We all consider Ron Paul to be a true supporter of our constitutional rights. However, some of you may not know that Ron Paul often works to circumnavigate the federal courts, including the Supreme Court, on certain moral issues of personal significance to him.

The practice, known as jurisdiction stripping, is simple. Congress and the Senate, by a simple majority vote, can bar the federal courts from hearing any cases regarding certain issues. For example, a simple majority vote is all that is needed to bar the Supreme Court from hearing habeas corpus appeals; or any other issue that the legislature deems appropriate. This practice is legal. However, subjecting our constitutional rights to the whims of the legislature is a major threat to the freedom of every American.

Ron Paul loves jurisdiction stripping. He continues to propose this sort of legislation on moral issues that are important to him, such as abortion. More specifically, he co-sponsored H.R. 3313 The Marriage Protection Act, which would ban the federal courts from hearing any appeals regarding the constitutionality of the Defense of Marriage Act. The Defense of Marriage Act, as we know, creates an unequal federal tax burden on same-sex couples that often results in them paying more than their heterosexual counterparts.

My point is simple: When it comes to his own personal moral agenda, Ron Paul seeks to strip the federal courts of their jurisdiction in order to advance his own beliefs. Imagine, for a moment, that another representative proposed a bill to ban the federal courts from hearing Second Amendment appeals; or even First Amendment appeals. Ron Paul would be screaming bloody murder from the rooftops and ranting endlessly in his cantankerous way about the threat to American’s rights.

Is Ron Paul a hypocrite? I’ll let you decide.

However, one thing remains clear. The act of jurisdiction stripping by the legislature is a terrifying prospect. Fascist interests on both the right and the left can essentially strip us of our most basic rights through a simple 51/49 majority vote. Anyone who engages in this practice, Ron Paul included, is gambling with our already besieged constitutional rights.

First Amendment? Who needs that anymore?
