Chief Justice Scalia and Public Education

I have long since rejected the notion that strong performance within the U.S. public education system correlates to above-average intelligence. I say this as one of the highest-testing students in Illinois and New York State history, and also as a high-school drop-out, having been fortunate enough to be both.

I submit to you that excelling within the U.S. public education system proves nothing beyond one’s ability to regurgitate to the state exactly what the state wants to hear.

As evidence of this, I present to you Antonin Scalia, straight-A student, and author of one of the most disgusting dissenting opinions in the history of the United States Supreme Court (begins on pg. 110).

Justice Scalia embodies the strict constructionist perspective. The Constitution is a dead document. The country however is alive. Scalia, does his job well. The Justice is not a member of Congress nor is he a Governor or Cabinet Secretary.

Scalia is a wake up call to so called “Constitutionalists” to be aware of the practical limitations of the dead documents. For the dead can seldom protect the living.

Scalia would make a great interpreter of a truly free market libertarian “Lysander Spooner” inspired document. For a dead piece of parchment few have signed or sworn an oath to in any capacity, Scalia deserves a free meal at the Olive Garden. That’s about all folks!
